In this notice, “personal information” means any information about an identified individual as further defined in the laws applicable to Codem Limited Partnership (“Codem”).
1. Collection and Use of Personal Information
Codem collects and uses a variety of personal information from clients and others (the “affected persons”).
Types of personal information collected
Codem may collect and retain personal information such as last name, first name, contact information (mailing and email addresses, telephone number), date of birth, and payment information. Codem only collects personal information that is necessary for the purposes described in the paragraph below.
Collection of personal information
Codem collects personal information for a variety of purposes. It may collect personal information for the purpose of (i) selling goods or providing the required services, (ii) transmitting the information requested by the person concerned, (iii) subscribe the data subject to their request to a mailing list (including in particular the modification of their subscription settings and the deletion of their name from the mailing list), (iv) when they hold contests or (v) to comply with the law.
Codem may also collect personal information in order to better understand the profile of the individuals involved so that the information it receives is relevant or to customize this website to better meet the needs of individuals concerned.
The amount and type of personal information collected is limited to what is necessary for the purposes for which it is collected and collected from the individual. This information may, however, be collected from third parties where permitted by law.
Use of Personal Information Collected
Codem uses the personal information thus collected according to what is necessary, among other things, to sell the goods or perform the services required by the data subject, transmit the information requested by the data subject, make shipments (newsletters, commercial offers), to allow the contest to be held and to award the prize(s) to the winners or to comply with its legal and regulatory obligations, as applicable.
Codem may use personal information for other purposes that are disclosed, including when it is collected.
2. Disclosure of Personal Information
Subject to the persons described below, Codem does not disclose or sell personal information for purposes other than those set out in this notice unless the person concerned consents or is permitted by law.
Personal information (electronic or other) that is collected by Codem is not disclosed to anyone except Codem representatives, its service providers or agents for whom such information is necessary for the performance of their duties or the performance of their contract or mandate. This can, for example, be hosting or data management services, market analyses.
For these purposes, Codem or the third party service provider may store and process your personal information on servers or computers located outside of Canada. In addition, even if your personal information is kept in Canada, Codem’s representatives or service providers may be required to access or process your personal information from locations outside of Canada. Some of these sites located outside of Canada may be subject to privacy laws or standards that differ from those in Quebec. As a result, in certain circumstances, your personal information may be disclosed to government or law enforcement agencies that would not otherwise have access to your personal information if they were kept in Canada or were not accessible from a location outside Canada.
In addition, Codem may disclose or sell personal information to the extent provided for or required by law, including pursuant to court orders, or as necessary to establish, exercise or defend legal remedies.
3. Cookies and IP Addresses
Even if the data subject can visit this website (the “Site”) without telling Codem who they are and without revealing any information about them, by accessing the Site, information is automatically exchanged between the computer of the person concerned and the Codem server. This exchange of information does not allow Codem to identify the person concerned, his name or e-mail address. On the other hand, this exchange allows Codem to obtain the Internet domain name that the data subject used to access the Site, the IP address of the data subject, the type of browser and operating system used by the data subject to access the Site, the date and time the data subject accessed the Site, the pages visited by the data subject and, if the data subject reaches the Site from another site, the address of that site (referring site).
It is through cookies that the Codem Site’s operating system can automatically collect this information regarding the person’s visit to the Site. Cookies are small pieces of information stored by the data subject’s Internet browser on their computer’s hard drive, which allow Codem to recognize the data subject when accessing their Site. When the data subject browses the Internet, a cookie is used for the purposes described above. If the data subject does not wish to have information about their visit collected by Codem, they may, in their sole discretion, configure their browser to be notified when they receive a cookie or to prevent the sending of such cookies.
This information is used by Codem for advertising purposes and to measure the number of visits of visitors to the Site as well as the various pages they view, the average time visitors spend on the Site and in order to establish other statistics about visitors to the Site in general. This information also allows Codem to verify the performance of the Site, for the purposes of system administration, to make the Site easier and convenient to use and to report certain information, processed in a global manner, to representatives of Codem for whom the transmission of this information is necessary for the performance of their duties.
Codem only collects other personal information about the data subject who visits the Site if the data subject, in its sole discretion, decides to provide it voluntarily.
4. Security
Codem has implemented measures to ensure the protection of personal information in its custody, in particular against theft, loss, unauthorized access, use and communication by means of technical, administrative or physical security measures, reasonable taking into account, in particular, their sensitivity, the purpose of their use, their quantity, their distribution and their medium. The level of protection provided will therefore vary depending on the personal information.
Thus, among other things, when it considers it appropriate, Codem uses encryption or authentication tools, or both, as well as other methods to protect certain personal information from the Internet and stored on its servers.
Also, online access by a data subject to some of their personal information may be protected by a user name or password that they choose. Codem strongly advises data subjects not to disclose their user name and password to anyone. Codem never asks for a data subject’s password in an unsolicited message. Finally, the person concerned acknowledges and accepts that the e-mails that the visitor sends to Codem are not necessarily inviolable before arriving on Codem’s servers.
5. Option to Remove and Modify Personal Information
The Data Subject may access and advise Codem to update the Personal Information provided to Codem, and may request to modify or delete certain information collected by Codem, by sending an email to sae@codem.qc.ca or by replying to messages sent to them as a result of their subscription to the Codem mailing list.
In the same way, the data subject can request the withdrawal of a subscription to the Codem mailing list.
